Terms of Service
- Version:
- 1.2.0
- Last updated:

- Effective:

1. Agreement to Terms
Welcome to CreatorHyve! These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CreatorHyve ("CreatorHyve," "we," "us," or "our") governing your access to and use of the CreatorHyve platform, including our Agent Studio (AutoFlow), AI Content Generation, AI Image Generator, AI Video Generator, Content Calendar & Scheduling, Brand Kit, Media Library, Social Publishing, Credit System, and all related services, applications, and websites (collectively, the "Services").
By accessing or using CreatorHyve, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Services.
Important: These Terms contain an arbitration clause and class action waiver (Section 16) that affect your legal rights. Please review carefully.
2. Eligibility
To use CreatorHyve, you must:
- Be at least 13 years old (or 16 in the European Economic Area)
- Have the legal capacity to enter into binding contracts
- Not be prohibited from using the Services under applicable laws
- Provide accurate and complete registration information
- Maintain the confidentiality of your account credentials
If you are using CreatorHyve on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Account Registration and Security
3.1 Account Creation
You must create an account to access most features of CreatorHyve. You agree to provide accurate, current, and complete information during registration and to update such information promptly if it changes.
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your password and account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
3.3 Account Restrictions
You may not:
- Share your account with others or allow unauthorized access
- Create multiple accounts to circumvent limitations or restrictions
- Purchase, sell, rent, or lease access to your account
- Use another user's account without permission
4. Subscription Plans and Billing
4.1 Free Plan
We offer a permanent Free plan that provides limited access to the platform, including a small credit allowance to try AI generation. The Free plan does not include content scheduling, publishing, or connected social accounts. To access these features, you must subscribe to a paid plan.
4.2 Paid Subscriptions
Our paid subscription plans are Starter, Creator, and Scale, each billed monthly or yearly. The current prices, monthly credit allocations, usage limits, and features included in each plan are shown on our Pricing page and at checkout, and may change as described in these Terms. Higher plans include the features of lower plans plus additional capacity and capabilities.
All paid plans operate on a credit-based system. Each plan includes a monthly credit allocation. Credits are consumed when you use AI features (text generation, image generation, video generation, Agent Studio flows). Unused credits reset at the start of each billing period and do not carry over.
4.3 Credit System
CreatorHyve uses a credit-based system to meter AI usage:
- Each AI action (text generation, image generation, video generation, Agent Studio post generation) deducts credits from your balance
- Credit costs vary by feature and AI model — your account dashboard displays the cost of each action before you confirm it
- Agent Studio flows deduct 0.1 credits per generated post as each post is generated; image generation per post deducts additional credits based on the model used
- Credits are included with your subscription and are not sold separately
- A full transaction history of credit usage is available in your Billing > Credit Activity page
4.4 Billing and Payment
- Subscriptions are billed monthly or annually in advance based on your selection
- All fees are non-refundable except as required by law or stated in these Terms
- You authorize us to charge your payment method on a recurring basis
- We use Dodo Payments for secure payment processing; your payment details are handled directly by Dodo Payments and are not stored on our servers
- Prices are subject to change with 30 days' notice to existing subscribers
- Failed payments may result in service suspension or termination
4.5 Cancellation and Refunds
You may cancel your subscription anytime from the Billing page in your account. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that time. No refunds are provided for partial billing periods, except:
- Within 7 days of your initial paid subscription (annual plans only)
- If we terminate your account in violation of these Terms
- As required by applicable consumer protection laws
4.6 Auto-Renewal
Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription fee.
4.7 Inactive Accounts and Media Retention
To keep storage costs sustainable, we store your generated and uploaded images and videos only while your account is active. An account is inactive when it has had no paid subscription for 90 consecutive days. For accounts that have never subscribed, the 90 days are counted from the date the account was created. When an account has been inactive for more than 90 days, we permanently delete the images and videos stored in that account, including previews, and this cannot be undone.
- Your account, settings, brand kit, and the text of your posts and captions are not deleted by this rule
- Starting or renewing a paid subscription at any time before deletion keeps your media
- You can download your images and videos at any time before they are deleted
- This rule applies to media stored with CreatorHyve. Content you have already published to a social platform remains on that platform
5. Acceptable Use Policy
When using CreatorHyve, you agree NOT to:
5.1 Prohibited Content
- Generate or distribute illegal, harmful, or offensive content
- Create content that infringes on intellectual property rights
- Produce misleading, deceptive, or fraudulent content
- Generate sexually explicit, violent, or hateful material
- Create content that violates third-party platform policies (including YouTube, Instagram, X/Twitter, LinkedIn, Facebook, and the other platforms we support)
- Generate spam, malware, or phishing content
5.2 Prohibited Activities
- Reverse engineer, decompile, or attempt to extract our AI models
- Use automated tools (bots, scrapers) to access the Services, other than our Developer API with your own API key
- Attempt to circumvent usage limits, rate limiting, or security measures
- Interfere with or disrupt the Services or servers
- Impersonate others or misrepresent your affiliation
- Collect or harvest user data without consent
- Use the Services for competitive analysis or to build competing products
5.3 AI-Specific Restrictions
You may not use our AI features to:
- Generate deepfakes or manipulated media intended to deceive
- Create content impersonating real individuals without disclosure
- Train or fine-tune external AI models using CreatorHyve outputs
- Bypass content moderation or safety filters
- Generate bulk content for spam or manipulation purposes
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund, and we reserve the right to report illegal activities to law enforcement.
6. Content Ownership and Intellectual Property
6.1 Your Content
You retain all ownership rights to:
- Content you upload to CreatorHyve (brand assets, input prompts, etc.)
- AI-generated content created using our Services
- Your content calendar, schedules, and organizational data
6.2 License to CreatorHyve
By using our Services, you grant CreatorHyve a worldwide, non-exclusive, royalty-free license to:
- Store, process, and display your content to provide the Services
- Share your content with third-party providers necessary for service delivery
- Display your content in marketing materials (only with explicit opt-in consent)
This license terminates when you delete your content or close your account, except for content retained for legal compliance.
We do not use your content to train our own AI models. Your prompts and inputs are sent to the third-party AI providers described in Section 7.3 to produce the output you request, and those providers' own terms apply.
6.3 CreatorHyve's Intellectual Property
CreatorHyve and its Services (including software, algorithms, UI/UX, branding, and AI models) are protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or create derivative works of our platform
- Remove or alter copyright notices or proprietary markings
- Use our trademarks or branding without written permission
6.4 AI-Generated Content Attribution
While you own AI-generated content, we recommend disclosing AI usage where required by platform policies (including YouTube, Instagram, X/Twitter, LinkedIn, Facebook, and the other platforms we support) or applicable laws. CreatorHyve is not responsible for ensuring your content complies with third-party disclosure requirements. This includes but is not limited to YouTube's AI-generated content labels, Instagram's AI information labels, and any applicable regulatory requirements in your jurisdiction.
6.5 Copyright Infringement
We respect intellectual property rights. If you believe content on CreatorHyve infringes your copyright, please contact us at [email protected] with:
- Description of the copyrighted work
- URL or location of the infringing content
- Your contact information
- A statement of good faith belief that use is not authorized
- Electronic signature of the copyright owner or authorized representative
7. Third-Party Platform Integrations
7.1 Social Media Platforms
CreatorHyve integrates, or is rolling out integrations, with third-party social and blogging platforms, including YouTube, Instagram, X (Twitter), LinkedIn, Facebook, Pinterest, Threads, Bluesky, Mastodon, Telegram, Discord, Dev.to, Hashnode, and WordPress. Availability of each platform depends on that platform's approval and API access. When you connect these accounts:
- You authorize CreatorHyve to access your accounts per the OAuth permissions you explicitly grant
- We store encrypted OAuth access and refresh tokens, or the encrypted app password, access token, or bot token you provide for platforms that do not use OAuth, to enable scheduled and automated publishing on your behalf
- You remain responsible for complying with each platform's Terms of Service and Community Guidelines
- We are not liable for actions taken by third-party platforms, including account suspensions or content removals
- Platform integrations may be discontinued if third-party APIs change, are revoked, or become unavailable
- You may disconnect any platform integration at any time from your Connected Accounts settings
7.2 Agent Studio and Automated Publishing
The Agent Studio (AutoFlow) feature uses AI to generate and schedule content on your behalf. When using Agent Studio:
- You configure the flow settings (platforms, duration, posting schedule, content tone) and you are responsible for reviewing generated content before it is published
- In "Auto-publish" mode, posts are published automatically at the scheduled times without further approval; use this mode only when you are satisfied with the AI output quality
- In "Review queue" mode, generated posts await your explicit approval before publication
- Posts for platforms that require an image or video (currently YouTube, Instagram, and Pinterest) always wait in your review queue, whichever mode you choose, until you attach media and approve them
- Credits are deducted as each post is generated (0.1 per post) and additionally when you generate images for posts
- You remain solely responsible for all content published via Agent Studio flows, including compliance with platform policies
7.3 AI APIs and Processing
Our use of third-party AI APIs (OpenAI, Google AI, Anthropic, Fal.ai, Replicate, and others) is subject to their respective terms. Changes in API availability, pricing, or policies may affect our Services. We will make reasonable efforts to notify you of significant changes that impact your usage.
7.4 Platform Compliance
You are solely responsible for ensuring your AI-generated and automated content complies with the policies of platforms where you publish (e.g., YouTube's AI disclosure requirements, Instagram's Community Guidelines, X's Automation Rules, LinkedIn's Professional Community Policies).
7.5 TikTok
If you connect a TikTok account, these additional terms apply to your use of TikTok through CreatorHyve:
- You must have the right to post every video you publish, and you remain responsible for it, including compliance with TikTok's Terms of Service, its Community Guidelines and its music and commercial content policies
- CreatorHyve posts a video to TikTok only after you confirm its title and settings. You choose who can view it and whether comments, Duet and Stitch are allowed; we do not set these for you
- If a video promotes your own business, another brand or a third party in exchange for something of value, you must turn on the commercial content disclosure we show before posting and choose the right label. Posting confirms that you accept TikTok's Music Usage Confirmation and, for branded content, its Branded Content Policy
- TikTok sets the limits and visibility rules for posts made through third-party apps, including daily posting limits and, while TikTok's review of CreatorHyve is incomplete, private-only posting. TikTok may refuse, limit or remove a video, and we are not responsible for its decisions
- You can disconnect TikTok at any time in Integrations
8. Service Availability and Support
8.1 Uptime
We strive to maintain 99.9% uptime for our Services (excluding scheduled maintenance). However, we do not guarantee uninterrupted or error-free access. Services may be temporarily unavailable due to:
- Scheduled maintenance (announced in advance when possible)
- Emergency security updates
- Third-party provider outages (Supabase, Cloudflare, AI APIs)
- Force majeure events beyond our control
8.2 Customer Support
Support availability varies by plan:
- Free Plan: Help center and documentation only
- Starter Plan: Email support (48-hour response time)
- Creator Plan: Priority email support (24-hour response time)
- Scale Plan: Priority support and a dedicated account manager
8.3 Service Modifications
We reserve the right to modify, suspend, or discontinue any feature or aspect of the Services at any time with reasonable notice. We are not liable for any modification, suspension, or discontinuation of the Services.
9. Usage Limits and Fair Use
9.1 Credit-Based Usage
AI features are governed by a credit system. Each paid plan includes a monthly credit allocation. Credit costs per action are:
- Text generation (post captions, content ideas, prompt enhancement): 1 credit per generation
- Image generation: 2–15 credits per image depending on the AI model selected
- Video generation: 1–500 credits per video depending on the AI model and duration selected
- Agent Studio flow: 0.1 credits per post generated in the flow
- Post image generation (within a flow): charged at the standard image model rate
Your current credit balance and a full transaction history are visible in your Billing > Credit Activity dashboard. Credit costs for each action are shown before you confirm the action.
9.2 Feature Access by Plan
In addition to credits, certain features (for example scheduling and publishing, connected social accounts, Brand Kit, Agent Studio, and API access) are available only on certain plans, regardless of your credit balance. The plan required for each feature is listed on our Pricing page.
9.3 When Credits Run Out
If your monthly credit allocation is exhausted:
- AI features will be blocked until your allocation resets at the next billing cycle or you move to a plan with a larger allocation
- Plan credits reset monthly and do not carry over to the next billing period
9.4 Fair Use Policy
We expect reasonable use of our Services. Excessive usage that:
- Significantly exceeds typical usage patterns for your plan
- Adversely impacts service performance for other users
- Appears to violate our Acceptable Use Policy
May result in account review, usage restrictions, or plan adjustments. We will notify you before taking action.
10. Data Protection and Privacy
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using CreatorHyve, you consent to our data practices as described in the Privacy Policy.

For users in the European Economic Area (EEA), UK, or Switzerland, we comply with the General Data Protection Regulation (GDPR) and provide:
- Data access, portability, and deletion rights
- Lawful basis for processing (consent, contract, legitimate interest)
- Appropriate safeguards, such as Standard Contractual Clauses, for international data transfers (see Section 9 of our Privacy Policy)
10.2 CCPA Compliance
For California residents, we comply with the California Consumer Privacy Act (CCPA) and provide disclosure of data collection practices as described in our Privacy Policy.
